naka-ai Terms of Service

These terms cover your use of the naka-ai app and website (naka-ai.com and Naka Studio), operated by NAKA-AI Tech: signing up, credits, plans, renewal, prohibited use and responsibility for AI-generated content. By signing up for or using the service you agree to these terms. The Thai version is available at ภาษาไทย; if the two differ, the Thai version prevails.

1. Accounts and sign-in

You sign up with a phone number (verified by OTP) or a Google account. You are responsible for keeping your device and OTP codes safe. If you notice any unauthorised use, tell us immediately at +66 89 278 8587 · +66 99 656 7792.

2. Credits and how they are used

• Credits are spent to create clips, images and other AI work in the platform — the number of credits a job costs is shown in the app before you create it
• Credits are a right of use within the system; they cannot be transferred or exchanged for money
• If a job fails because of the system, its credits are refunded automatically (see the refund/cancellation policy, in Thai)
• Credits already used reflect actual usage and cannot be refunded, except for failed jobs as described above

3. Plans and renewal

• Plans are prepaid, monthly or yearly. Prices and what each plan includes are shown on the plans page on the day you buy
• You pay by PromptPay or card on the checkout page of our payment provider, Stripe — we never store your card number
• When the period ends, the plan simply ends. We do not charge you automatically — you can renew yourself on the plans page or ask us by phone
• Sign-up bonus credits and promotions follow the conditions stated at the time of the campaign, and may be changed or ended with prior notice

4. Prohibited use

• Creating or publishing anything illegal, deceptive, obscene, abusive, or that infringes the rights of others
• Using other people’s images, voices or personal data without permission (including impersonating another person or brand)
• Using content that breaks the rules of the platforms you publish to, such as the terms of Meta (Facebook/Instagram), TikTok or LINE
• Attempting to break into the system, disrupting it with bots or scripts, or using the service beyond what your plan allows

If you break these rules, we may reasonably suspend your account or the related work, and we will let you know.

5. AI-generated content

Content the system helps create (scripts, text, clips, voice) is generated from the information you provide and AI models, and may not always be accurate or complete. Therefore:

• You must review everything before you publish it — the accuracy of prices, promotions, product claims and commercial promises is your shop’s responsibility
• You are responsible for the content posted to your shop’s channels, including compliance with Thailand’s Direct Sales and Direct Marketing Act, electronic commerce rules and applicable advertising laws
• Never publish content that breaks section 4

6. Service availability

We aim to provide the service consistently, but it may be interrupted temporarily for maintenance, problems at upstream providers, or events beyond our control. We announce planned downtime through our channels. These terms do not limit your rights under consumer protection law.

7. Suspending or closing an account

You can ask us to close your account and delete your data as described on the Data deletion page (in Thai). Closing your account makes your remaining credits and work data unusable, except receipts and payment records that we keep as required by law.

8. Governing law

These terms are governed by the laws of Thailand. We will first try to settle any dispute amicably; if that fails, it will be resolved in accordance with the law.
